Thank you.dg.petch@btinternet.com v 1832 Donated by mcsheffrey@cyberlink.bc.ca This is the last Will and Testament of me William Mentoft of Great Driffield in the county of York Gentleman made and published this twelfth Day of January in the year of our Lord One Thousand eight hundred and thirty two. First I order and direct all my just debts funeral and testamentary expenses to be fully paid and satisfied out of my personal Estate by my Executors hereinafter named I give and bequeath all my household Goods furniture plate linen china pictures and Books unto my dear Wife Ann Mentoft for and during the term of her natural life and from and after her decease I give and bequeath the same deed every part thereof unto my daughter Mary Read for her own absolute use and benefit. I give and bequeath all the Estates which at the time of my decease shall be vested in my upon any trusts or by way of Mortgage in fee or for terms of years of which I have power to dispose by this my Will with their Rights members any appurtenaces together with all monies secured by or upon any such Mortgages and also all other Monies securities for money goods chattels personal Estate and effects whatsoever and wheresoever and of what nature or kine soever the same may be (except such parts thereof as are hereinbefore by me specifically disposed of unto my daughter Mary Read of Great Driffield aforesaid and my son in law Samuel Barker of Nafferton, Grocer their Executors administrators and Assigns Upon the Trusts and to and for the Ends Intents and Purposes and with under and subject to the powers provisos and declarations hereinafter expressed of and concerning the same that is to say upon Trust that they the said Mary Read and Samuel Barker and the survivor of them and the Executors administrators and assigns of such Survivor do and shall with all convenient speed after my decease call in or allow the money due to me upon any security whatsoever to continue upon such Securities for any length of time at their or her or his discretion And I do hereby declare my Will and Mind to be that they the said Mary Read and Samuel Barker their Executors Administrators and assigns and the survivor of them and the Executors administrators and assigns of such survivor shall stand and be possessed of and interested in all and singular the monies to come to their her or his hands under the trust of this my Will Upon trust to lay out and invest the same after paying my debts funeral expences and the charge of proving this my Will as hereinbefore directed principal monies in their her or his name or names in and upon Government or real Securities with power for them her or him to alter vary and transfer the same from time to time unto or upon other stocks funds and securities of the like nature and do and shall pay the whole of the Interest Dividends and annual produce to arise from all and every part Of the said trust Estates and so soon as the same shall become due and received by my said trustees unto my said dear Wife and her assigns for and during the term of her natural life to and for her own absolute use and benefit. And after the decease of my said Wife I give and bequeath unto my said daughter Mary the wife of Thomas Read the sum of one hundred pounds for her own sole and separate use and benefit. And it is my Will and Meaning that the said Thomas Read shall not have any control over nor be entitled to receive from any trustees on single farthing of the same but that my said daughter Mary Read shall receive the same to her own sole use and benefit and free from the debts control or engagements of her said husband and the receipt of my said daughter Mary Read alone, notwithstanding her coverture shall be a good and sufficient discharge to my other trustee for payment of the said Legacy or sum of one hundred pounds and after the decease of my said dear Wife I give and bequeath the following legacies to the persons hereinafter mentioned that is to say - to my son William Mentoft of the town of Manchester Gentlemen and to my daughter Ann the wife of the said Samuel Barker and to my daughter Isabella the wife of William Savage of Wetwang the sum of one hundred pounds each, and to my daughters Sarah wife of Michael Robson and Rosa wife of Matthew Robson the sum of Eighty pounds each, and to my daughter Catherine the wife of Isaac Johnson, labourer who has lately gone to reside in the United States of America the sum of Eighty pounds. – And I direct that the said Legacies hereinbefore given shall become vested in each of the said Legatees immediately upon my decease but the payment thereof shall not be made till six calendar months next after the decease of my said dear wife and subject as aforesaid I give and bequeath all the rest residue and remainder of my monies and effects ins any whatsoever and wheresoever unto and equally between and among my said son William Mentoft and daughters Mary Read, Ann Barker, Isabella Savage , Sarah Robson, Rosa Robson and Catherine Johnson to be vested Interests in each of them and paid and payable by my said trustees at the same time ad their respective Legacies and I do hereby declare it to be my Will and Mind that the share or oart of such residue as shall be payable to my said daughter Mary Read shall be paid to her subject to the same Restrictions Limitations and Directions as is herein before expressed and declared of and concerning her specific and original Legacy. And I do here by nominate and appoint the said Mary Read and Samuel Barker and the survivor of them joint trustees. And hereby revoking all former and other Wills by me at any time here to fore made I declare this to be my only last Will and Testament. In Witness whereof I the said William Mentoft, the Testator have to this my Will contained in three sheets of paper affixed together, set my hand at the bottom of each of the two preceding sheets and my hand sand seal to this third and last sheet, the day and year first above written, William Mentoft
Whereas I William Mentoft of Great Driffield in the County of York, Gentleman have duly made and executed my Last Will and Testament in writing bearing the date the Twelfth day of January one thousand and eight hundred and thirty two Now I do hereby declare this present writing to be as a codicil to my said Will and direct the same to be annexed thereto, and taken as part there of and whereas in and by my said Will I have given and bequeathed unto my daughter Isabella the wife of William Savage of Wetwang the Legacy or Sum of one hundred pounds payable to her six calendar months after the death of my Dear wife Ann Mentoft.Now I do hereby revoke the said Legacy and in Lieu there of do give and beaqueath unto my said daughter Isabella Savage the Legacy or sum of eighty pounds only to be paid to her, six calendar months after the death of my said dear wife Ann Mentoft, and on more and I do hereby give and bequeath unto my daughter Rosa the wife of Matthew Robson in the said will named the further sum of twenty pounds sterling in addition to what I have given her in and by my said will, to be paid to her six calendar months after the decease of my said dear wife Ann Mentoft and hereby ratifying and confirming my said will in all and other particulars thereof, I the said William Mentoft have to this Codicil set my hand and seal, this ninth day of Febuary in the year of our Lord one thousand eight hundred and thirty two. Signed sealed published and declared by the Testator William Mentoft having been first read over to him and duly explained as and for a Codicil to be annexed to and taken as part of his last Will and Testatment in the presence of us Thomas Ibbotson William Vickerman Junior Will of Samuel Barker of Nafferton Died 2 July 1863 Donated by mcsheffrey@cyberlink.bc.ca This is the last Will and Testament of me Samuel Barker of Nafferton in the County of York Grocer. I give and bequeath unto my three children Jane Hanannah the wife of Benjamin Robinson, Mary Barker and Michael Barker and my granddaughter Emily Ann Perrin the sum of nineteen guineas a piece to be paid to each of them at the expiration of six calendar months after my decease. I give and bequeath to my son William Barker an annuity of sixteen pounds yearly for his life and charge the same on my real estate hereinafter devised to my two daughters Ellen Barker and Sarah Jane Barker and I will and direct in order that my said son William may not have any power to charge or incumber his said annuity that the same shall be paid into his own hands and that his receipt alone and of no other person or persons shall be a sufficient discharge for the same annuity and I direct that each annunity shall be paid by equal quarterly payments the first payment thereof to begin and be made at the expiration of three calendar months next after my decease. I give devise and bequeath all my real and personal estate and effects of what nature kind or quality soever the same may be or consist and whatsoever unto my said two daughters Ellen Barker and Sarah Jane Barker their heirs executors administrators and assigns absolutely to be equally divided between them and I charge the said real estate so devised to them with payment of the said annuity of sixteen pounds to my son William Barker I appoint my said two daughters Ellen and Sarah Jane Barker joint Executrixes of this my Will and hereby revoking all former and other Wills by me made I declare this to be my Last Will and Testament in Testimony whereof I have hereunto – set my hand and subscribed my name this eleventh day of June in the year of our lord one thousand and eight hundred and sixty-three. Signed by the said Testator as and for his last Will and Testament in the presence of us who in the presence at his request and in the presence of each other have hereunto subscribed our names as witnesses. – George Hodgson Solicitor Driffield Henry Stephenson George Hodgson, died 20 Sept, 1874 Donated by mcsheffrey@cyberlink.bc.ca This is the last Will and Testament of me George Hodgson of Great Driffield in the County of York Gentleman I give and bequeath to my dear wife Ann Hodgson all my household furniture beds bedding plate linen china to and for her own use absolutely I have stettled a field in Spetton Road to the sue of myself and wife for our joint lives and although I keep the land for my life in the event of my surviving my wife she takes the same field afterwards in fee and can dispose of it and I hereby confirm I give and devise all that my Close of land containing about twenty acres purchased by me of the trustee of the late John William Drinkrow unto my cousins William Duggleby the younger and Michael Lawston Duggleby their heirs and assigns Upon trust to permit my said dear wife to receive the rents for her life and if my mother shall surive her to permit her to receive the rents for her life and after the decease of my dear wife and mother Upon trust to sell the same Close either by public sale or private contract and then upon trust to invest the purchase money and pay one half the income to arise there from to my Sister Ann Southuch and the other half to my Sister Sarah Secrey for their own use independent of any Husband and without power of anticipation and the receipt of my said Sisters and of no other person shall be a discharge to my said trustees or trustee for such income and the principal shall go in equal monies to the Children of my said Sisters as they shall repectively die in equal shares and proportions and if either or both leave but one said chidle the whole money shall go to such only child. I give and devise all those my two dwellinghouses and gardens now occupied by Widow Bell and Frederich Ostler unto my said dear wife for her life and after her death to my Sister Jane Layborn her heirs and assigns for every All the rest of my farming stock crops implements and other personal estate together with all other real estate of what nature kind or quality soever the same may be consist I Give and devise and bequeath the same unto the said William Duggleby the younger and Michael Owston Duggleby their heirs executors administrators assigns Upon trust to convert my Personal Estate into money subject to the bequests hereinaftercontained to place the remainder out at interest and pay income to arise therefrom to my said wife for her life and after her death to pay the principal to my two Brothers Francis and John Hodgson for their own use in equal shares subject to the retaining of two hundred pounds as herein after mentioned and so to my real estate to permit my said wife to receive the rents and income for her life and after her death to transfer and hand over the same to my said two brothers Francis and John Hodgson in equal shares as tenants in common for their own use absoletley Provided and I do hereby empower my said Trustees or Trustee with the consent of my said wife to sell any part of my residuary real estate and to place out the purchase money at interest and pay the income to my said wife and the principal to go to my said brothers in the same way as my other personal state is to be divided I appoint my said two Brothers Francis and John Hodgson to be residuary legatees and devises under this my Will………………………………….. After my decease and each of my brothers to retain the sum of nineteen guineas for their own use and out of the income of my residue real and personal property I give in maturity of thirty pounds to my said mother which shall be part or attained by my said wife out of the income and to secure the due payment thereof half yearly I empower my said mother to distain for the same if necessary as landlords distain for rent in arrear and before handing residue to my said Brothers I direct my said trustess or trustee to set apart and invest two hundred pounds Will of Richard Woodmansey, of Ruston Parva, dated 22 December 1877 This is the last will and testament of me, Richard Woodmansey, of Rudston Parva in the East Riding of the County of York, joiner, made by me this twenty second day of December one thousand eight hundred and seventy seven. I give to me daughter Ann Woodmansey, all my household furniture linen plate pictures etc found in my dwelling house at the time of my decease to be valued and out of the sum arising from such valuation all my funeral and Testamentory expenses also the providing of this my will to be paid and the residue to be divided in equal shares among my three sons and three daughters. I also give to my son George Renton Woodmansey the sum of five pounds annually until he shall arrive at the age of twenty years. I also give to my daughter Elizabeth Woodmansey the sum of five pounds annually until she shall arrive at the age of Twenty years. I also give to my daughter Harriet Woodmansey the sum of Ten pounds annually until she shall arrive at the age of fifteen years and after that five pounds annually until she arrive at the age of Twenty years. I also give all my work tools, tool chests to be equally divided between my two sons John William Woodmansey and George Renton Woodmansey. I also give my livestock, stock in trade, fixtures etc to be taken by the oncoming Tenant at a valuation the proceeds of such valuation to be divided in equal shares among my sons and daughters. I also appoint my son Richard Woodmansey of Driffield and George Walkington of Bridlington, Mason my Trustees and the above annuities to be paid by them out of the rents of four cottages and a grass field on the East side of the cottages containing about two acres more or less situate at Kilham in the said Riding. I also give to my son Richard Woodmansey and George Walkington their executors and administrators upon trust to sell by public auction the aforesaid property in Kilham where my youngest daughter shall arrive at the Twenty years and out of the proceeds to give Wilson Postil Cape joiner the sum of nineteen pounds, also to Thomas Postil Chape an equal sum of nineteen pounds and after all my just debts are paid the residue to be divided in equal shares between my sons and daughters. Richard Woodmansey In witness whereof I have hereunto set my hand the day and year first herein written Signed by the said Richard Woodmansey as his last will and Testament in the presence of us present at the same time who in his presence, at his request and in the presence of each other have hereunto subscribed our names as witnesses William Wilson, William Dixon The Will of Alfred Hogdson of Nafferton, Yorkshire Died 29 November 1880 Donated by mcsheffrey@cyberlink.bc.ca This is the Last Will and Testament of me Alfred Hodgson of Nafferton in the County of York Engineer. I give and bequeath unto my friend Luke White of Great Driffield Solicitor the sum of two hundred and fifty pounds Upon trust to invest the same and pay the interest or income to arise there from to my wife or reputed wife …. Susannah Hodgson ( I having married or gone through the ceremony of marriage with her she being my sister in law) until my son Alfred Hodgson shall attain the age of twenty one years she maintaining and educating my said son and on my said son attaining twenty one years of age I direct the said Luke White to pay the said sum of two hundred and fifty pounds or the amount to arise from the investments then representing the same unto my said son Alfred Hodgson which I bequeath all my real and personal estate whatsoever and wherever unto the said Susannah Hodgson for her own and absolutely subject to the payment of the said sum of two hundred and fifty pounds to the said Luke White upon trust as aforesaid and I appoint the said Susannah Hodgson Sole Excutrix of this my Will in witness whereof I have hereunto set my hand this nineteenth day of November 0ne thousand and eight hundred and eighty. Duncan Curate of Nafferton Thomas Ward Joiner of Nafferton Proved at York the eighteenth day of December 1880 by the oath of Susannah Hodgson Widow( Widow of a late brother of the Testator) the Sole Executrix to whom Administration is granted. The Will of Anne Hodgson of Great Driffield Died August 4, 1888 Donated by mcsheffrey@cyberlink.bc.ca This is the last Will and Testament of me Anne Hodgson of Great Driffield in the County of York Widow. I give and bequeath my best silver tea and coffee service, sliver cake basket two silver sugar bowls two pairs of silver salt spoons four sliver salts four silver table spoons marked “M” nine silver dessert spoons one pair of large gravy spoons two silver ladles one dozen silver dinner forks one dozen silver dessert forks a silver cruet stand set of six best decanters my best tea service “purple and gold” my dinner service “ old blue” my tea service “ green and gold” my dessert service my gold watch and chain all my linen china and glass of every description all my jewellery and trinkets and also all the furniture pictures old china and all other effects which shall be in my drawing room and my best lodging room at my decease unto my niece Emily Ann Perrin for her own use absolutely I give and bequeath a gold watch chain and seal belonging to my late husband unto George Hodgson (the son of my late husband’s brother John Hodgson) for his own use absolutely I give and bequeath all the rest of my silver whatsoever of which I shall be possessed at my decease Also all the pictures the chimney glass and time piece in y dining room unto my Nephew George Herbert Hodgson for his own use absolutely my Trustees and Executors to make an inventory thereof and deliver the same to my said Nephew on attaining twenty one years of age if he should die under that age then I give and bequeath the same unto my said Niece Emily Ann Perrin in the same way as if such silver, pictures chimney glass and time piece had been included in the bequest hereinbefore contained. In exercise and execution of the power reserved to or vested in me by an indenture dated on or about the ninth day of April one thousand eight hundred and seventy two and made between Bernard Ulluthorne and Fanny Ulluthorne of one part and my late husband George Hodgson of the other part I direct limit and appoint all that close of land called” Townend Close” containing sixteen acres and thirty two perches or thereabouts situate in Spellowgate or Cowlan Road in Great Driffield aforesaid unto and to the use of Richard Duggleby the younger of Cawkill in the Parish of Watton in the county of York Farmer and Luke White of Great Driffield aforesaid Gentlemen their heirs and assigns. Upon trust as hereinafter mentioned and I give and devise and bequeath all the rest of my personal estate and effects and all my real estate and property whatsever and wherever situate unto the said Richard Duggleby and Luke White upon Trust as hereinafter mentioned and I direct that the said Richard Duggleby and Luke White (hereinafter called my said Trustees or Trustee) shall stand possessed of the said close of Land hereinbefore appointed and all my said real and personal estate hereinbefore devised and bequeathed upon trust to convert my personal estate into money and to sell the said close of land and all my real estate either by public auction or private contract and I direct that my said Trustees or Trustee shall stand possessed of the monies ( hereinafter called trust monies) to arise from my said personal estate and my said close of Land and real estate as aforesaid Upon Trust to pay all my debts funeral and testamentary expenses and the costs and charges of proving and registering this my Will and of carrying out the Trusts thereof and then to pay the following legacies which I bequeath accordingly and direct the same to be paid free of legacy duty namely to my brother William Barker fifty pounds to my sister Ellen Foster fifty pounds to my cousin Mary Jane Stabler twenty pounds To my cousin Eliza Calder twenty pounds to Betty Skinner of Sculcoates in Hull twenty pounds , twenty pounds to Mary Watson of Sledmere (the daughter of my Cousin Jane Watson) twenty pounds and to my Trustees and Executors ten pounds each and I direct my said Trustees or Trustee shall retain out of the said trust monies the sum of one hundred pounds ( free of duty) and pay the same to my cousin Rebecca Savage by quartley instalments of five pounds until the same shall be exhausted the first payment to be made at the end of three calendar months after my decease And I direct my said Trustees or Trustee shall set apart and invest out of the said Trust monies in their or his name or names the sum of eight hundred pounds and pay the income to arise from as and when the same shall be come due and not by way of anticipation into the proper hands of my Brother William Barker for his life to be enjoyed by him as a personal provision so that he shall not have forever to deprive himself of the same anticipation and his receipts alone shall be a sufficient discharges to my said Trustees or Trustee and that if the said income shall in any maner become vested in any other person or persons than the said William Barker either by operation of law or otherwise then the said income shall cease as if the said William Barker where dead. And I direct that my said Trustees or Trustee shall pay one half residue of the trust monies unto my said Nephew George Herbert Hodgson if he shall live to obtain twenty one years of age and also pay him ( if he shall live to obtain twenty one years of age) half of the said sun of eight hundred pounds or half the amount to arise from the investment then representing the same on the death of the said William Barker and I give and bequeath the same accordingly But if he shall die before attaining twenty one years of age then I direct that the same shall be paid and applied in the same manner as hereinafter mentioned with respect to the other half thereof and I direct that my said Trustees or Trustee shall set apart and invest the remaining one half of the residue of the said trust monies and also the remaining one half of the said sum of eight hundred pounds the amount to arise from the investments then representing the same one the death of the said William Barker and shall pay the income thereof as and when the same shall become due unto my said niece Emily Ann Perrin for her sole and separate use and on the decease of the said Emily Ann Perrin I give then principal money to the child if only one or for all the children in equal portions as tenants in common if more then one of said Emily Ann Perrin who shall live to attain the age of twenty one years but if only one child or children of the said Emily Ann Perrin shall live to attain the said age then I direct the same to be paid to such person or persons as the said Emily Ann Perrin shall died or will whether covert or sole appoint I direct my said Trustees or Trustee to pay and apply the income of the money bequeathed to my said nephew George Herbert Hodgson for his maintenance education and benefit until he attains twenty one years of age in such manner as my said Trustees or Trustee shall think proper I direct my said Trustees or Trustee to pay the said William Barker out of the said trusts the sum of forty pounds per amum by half yearly payments with the said sum of eight hundred pounds shall be invested I direct that the said Luke White not with standing his being one of the Trustees and Executors under this my Will shall and may act as the Solicitor under this my Will and shall be allowed all professional charges which if employed as Solicitor to my Trustees or Excutors not being himself a Trustee or Executor he would be entitled to make any law or usage to the contrary in anywise un withstanding and I appoint then the said Richard Duggleby the younger and Luke White Executors of this my Will in witness whereof I have hereunto set my hand this twentieth day of August one thousand eight hundred and eighty three. Grant Clerk to Mr. Luke White Solicitor Driffield Robert Land Gardner Driffield Proved at York the thirty day of October 1888 by the oaths of Richard Duggleby the younger and Luke White the Executors to whom Administration was granted. The Testatrix Anne Hodgson was late of Great Driffield in the County of York Widow and died on the fourth day of August 1888 at Great Driffield aforesaid. Gross amount of personal estate 840 pounds no leaseholds. Extracted by Luke White Solicitor Driffield. Will of John Petch, of Skerne, born Skerne Feb 21, 1868, died Skerne 3 July, 1925. Buried Skerne Parish Church yard. This is the last will and testament of me John Petch of Skerne in the County of York Poultry Dealer I give and bequeath to my wife Alice Green Petch all my household furniture and effects absolutely I appoint my said wife and Benjamin Wilson of Bainton trustees and executors hereof I give devise and bequeath to them all the rest residue and remainder of my estate and effects upon trust to sell and convert the same into money by public auction or private contract with full power to delay such sale during the lifetime of my said wife and after payment of my debts funeral and testamentary expenses interest the proceeds of such sale and out of the income to arise therefrom and the income of any joint of my estate remaining unsold and so far as the same shall in the opinion of my trustees be insufficient out of he capital pay my wife during the minority of my son Edward Wilson Petch such sums as they may consider necessary for the maintainance of my said wife and any family I may then have and on the attainment of the age of twenty one years by my said son Edward Wilson Petch pay to him the sum of two hundred pounds and for the purpose of raising such sum my said trustees may mortgage any part of my estate there remaining unsold and from and after such time the income and capital of my said estate shall at my said trustees discretion continue to be applied for the benefit of my said wife and infant children (if any) during her life and widowhood and from and after the death or remarriage of my said wife I give the whole residue of my estate in equal shares to all my children who may survive me including the said Edward Wilson Petch provided always that in case any child of mine shall die in my lifetime leaving a child or children surviving me such child or children shall take more than one equal share between them the share or interest to which his her of their parent would have benefited if such parent had survived me In witness whereof I have hereto set my hand this twentieth day of May one thousand one hundred and thirteen.
